Act immediately against Sri Lankas Fisheries Bill Vaiko tells Centre

Apprehending such a move, Vaiko said he had met Prime Minister Narendra Modi as early as in July 2017 and impressed upon him the need to convey to his Sri Lankan counterpart the consequences that fishermen may face in the future if such proposals were implemented. (Colombo Gazette) Speaking to reporters, Vaiko said the proposed law, which had the approval of the Sri Lankan government’s cabinet, would give more powers to the Sri Lankan Navy personnel to arrest Indian fishermen and seize trawlers and fishing nets. Brock adopts new Fair Dealing Policy

By MikeBlogs ( Feb. 14, 2013, Brock’s Board of Trustees Financial Planning, Investment and Human Resources Committee approved a new Fair Dealing Policy.The new policy gives guidance to faculty and staff when copying and sharing copyright materials under the fair dealing exception in the Copyright Act and replaces a previous policy that became outdated due to developments in case law and legislation.The policy, which has already been adopted by other universities, colleges and schools across Canada, provides Brock instructors with much more flexibility and certainty when sharing copies of materials with students.It allows instructors to copy short excerpts of materials, such as one chapter per book, one article per journal issue, or up to 10 per cent of a work, and share the excerpts with students through Isaak/Sakai, as a print handout, or in course packs.For more info about the policy, visit the University’s Fair Dealing website, or contact copyright@brocku.caThe Library and Centre for Pedagogical Innovation will be offering workshops to explain the new policy in the near future. Attorneys for Penney Macys present final arguments on Martha Stewart case

NEW YORK, N.Y. – After a three-month break, attorneys for J.C. Penney Co. and Macy’s Inc. squared off in a New York court Thursday as they presented closing arguments in a contract dispute case centred on their partnership with home maven Martha Stewart.Mark Epstein, one of the lead attorneys representing Penney, told New York State Supreme Court Judge Jeffrey Oing that if Macy’s wanted to prevent others from selling goods in its exclusive categories like pots and bath items, it should have written a better contract.And Theodore Grossman, who represents Macy’s, said Penney was using any excuse to hide the reality that it intentionally interfered with Macy’s contract with Martha Stewart when it signed a merchandising deal in December 2011.“It’s been a long trial. But what it comes down to is a poorly written contract,” argued Epstein. “Time has come to put an end to this case.”Grossman argued that Penney, based in Plano, Texas, aggressively induced Martha Stewart Living Omnimedia to breach the contract and that the contract is clear that Macy’s has the right to all the designs created by the home maven in the exclusive categories, not just specific products.“J.C. Penney knew exactly what it was doing when it entered into the contract,” said Grossman. “Their intention was to harm Macy’s.”Oing promised he would make a ruling on whether Macy’s has exclusive rights to sell certain merchandise including bed, bath and kitchenware items “soon,” but he said it wouldn’t be Friday. The decision would cap a closely watched trial that began in February but continued in fits and starts because of vacation schedules and other interruptions. At one point, Oing even ordered the parties into mediation in March, but that was unsuccessful.The trial featured testimony from Macy’s CEO Terry Lundgren, former Penney CEO Ron Johnson, and Martha Stewart herself. Johnson appeared on the stand just a month before he was fired as Penney CEO, 17 months into his tenure.Cincinnati-based Macy’s Inc. sued Penney and Martha Stewart Living Omnimedia Inc. for violating an exclusive deal between the home maven and Macy’s when Penney signed its own agreement with Stewart in 2011.Macy’s is suing Penney for what it believes was intentional interference with Macy’s contract with Martha Stewart. It is seeking not only to block Penney from opening mini boutiques filled with Martha Stewart-branded goods in certain categories, but also to prevent it from selling designs created by Martha Stewart that do not carry her name. The company also seeks monetary damages.One of the loopholes Martha Stewart and Penney have focused on is a provision in the contract that allows Martha Stewart to sell goods covered by the exclusive pact in Martha Stewart Living’s own stores. Penney and Martha Stewart have argued that since the Macy’s contract does not specify that the stores have to be stand-alone, the mini shops within Penney aren’t barred by the exclusivity agreement.“That definition that Macy’s wrote just stinks,” Epstein argued.The stakes are high for all three players, but particularly for Penney, which has been counting on a revamped home area launched this spring to help it rebound from a disastrous year. The company amassed nearly a billion dollars in losses and its revenue dropped 25 per cent for the fiscal year that ended Feb. 2 as a transformation plan spearheaded by Johnson built around a new pricing and merchandising strategy failed. Losses and sales drops continued into the first quarter, as the shadow of Johnson’s legacy remained.Penney’s board brought back its CEO Mike Ullman who has reintroduced frequent sales events and basic merchandise that Johnson eliminated in a failed bid to attract trendier, wealthier customers. But while traffic is improving, analysts believe business is still slow. Even the home area, which was Johnson’s project and features a slew of trendy new names like Jonathan Adler and Michael Graves, has failed to resonate with shoppers, analysts say.A new round of worries about Penney’s financial situation cropped up Wednesday after a report that CIT Group Inc., the largest lender in the clothing industry, has stopped providing financial support to small and large suppliers selling to Penney stores for now. Penney said that the report was untrue and that CIT backed shipments for less than 4 per cent of its merchandise anyway.In July 2012, Macy’s won a preliminary injunction against Martha Stewart Living that would prevent it from selling Martha Stewart-branded housewares and other exclusive products at Penney. A month later, the judge granted permission for Penney to open Martha Stewart shops as long as the items under exclusive contract with Macy’s are not sold.Penney went ahead and ordered goods designed by Martha Stewart in the exclusive categories but sidestepped the preliminary ruling by labeling them JCP Everyday. Macy’s tried to get the judge to halt the sale of the JCP Everyday goods until he made his final ruling, but he declined and allowed Penney to sell the goods that were already made.The JCP Everyday collection hit the stores in May. When Stephen Curry, the newly minted MVP, was asked about his Golden State Warriors’ upcoming matchup with the Houston Rockets and James Harden, who finished as the runner-up in MVP voting, Curry responded:“All those story lines kind of end once the game starts for us because we understand it’s a team game and neither one of us is going to go out and win four games by ourselves.”We’re inclined to agree with Curry. The series is about the teams, not specific players — especially because Curry leads a historically dominant Warriors team. Golden State has a 91 percent chance to beat Houston, according to our Real Plus-Minus projections.Although …Since 1985, the top two players in MVP voting have gone on to meet in the playoffs seven times. (Curry vs. Harden will be the eighth.) In those matchups, the MVP winner led his team to victory five times. Bailieu Governments clearways policy will have a big impact on traders

first_img Facebook Twitter: @NeosKosmos Instagram The leader of the Victorian Opposition, Ted Bailieu has expressed his lack of confidence with the way the government has handled the implementation of the clearways extension while underscoring the policy’s impact on inner city shopping strips. “I certainly believe, as do traders affected by clearways, that it will have a big impact on their trade,” the Leader of the Victorian Opposition said to Neos Kosmos English Edition (NKEE). “Traders have only received a token response from the Brumby Government, and the Minister for Roads should release the economic impact statement and the studies they have claimed they have done,” Mr Bailieu added. His comments followed a defiant stance adopted by the City of Stonnington regarding the clearways earlier this month. City of Stonnington Mayor Cr Tim Smith rejected a Ministerial determination released on New Year’s Eve that validates VicRoads policy decision to extend clearway hours. “The timing of this decision should ring alarm bells. If the Minister is so confident this is the right decision why would he try to bury it by releasing it at five minutes to midnight on New Years Eve?,” Cr Smith said. In his determination the Minister for Roads Tim Pallas said he believed all economic, social and environmental impacts had been considered in making the decision. “The Minister’s determination simply states that these factors have been considered, it provides no evidence of such,” the Mayor of Stonnington underscored. The City of Stonnington has done its own independent studies by economic experts who have found that if clearway hours are extended, High Street traders alone stand to lose $6 million a year, according to conservative estimates. At the same time graphs from Yarra Trams have showed public transport travel time savings of as little as three minutes over 6km, pointed out the Mayor of Stonnington. Cr Smith indicated that the Council would seek legal advice on the Minister’s decision. “But our position is clear – we will continue the fight, we will not abandon our traders as the State Government has done,” he said. The chairman of Streets Ahead Inc. which represents among other Chapel St traders, James Pothitos called for the government not to ignore the traders. “Every [government] decision has its consequences,” Mr Pothitos said. “If one business shuts down that is considered a loss what if 10 or 100 businesses shut down what’s going to happen then,” Mr Pothitos added rhetorically. Responding to the criticism raised by the Mayor of Stonnington a spokesperson for the Minister of Roads and Ports Tim Pallas said that the government is “taking action to ensure Melburnians can spend more time with their families and less time in traffic.” “We have made some amendments to the clearways times following feedback from the Stonnington City Council and we now hope to start installing the new signs before the end of this month,” the Minister spokesperson added. first_imgA vision of LinkedIn as a place that “makes the business world smarter” lured MediaNext keynoter Dan Roth from a successful career in traditional media to lead the editorial operations at the social network for business professionals.Informing business professionals had always been top of mind for Roth, who spent many years as a writer for Fortune and Wired, and who eventually led Fortune’s digital offerings. However, the opportunity to directly reach the vast network of digital professionals that LinkedIn serves by building up its information-sharing infrastructure was too appealing to resist.But why, as Roth’s keynote topic at FOLIO:’s MediaNext conference in New York posited, does LinkedIn actually need an executive editor? Tampa Bay Comic Con brings in thousands of attendees, and the unique show continues to grow with each passing year. Where most comic conventions these days push their artists and creators to a back wall, making room for gigantic t-shirt booths or media props and cutouts; Tampa Bay Comic Con gives the golden age; as well as the rising comic creators the respect they deserve. Artists are not just lined up in one sad row in the back. They are cascaded throughout the show floor ready to interact with their fans, and it is truly a beautiful thing that I feel is missing at a lot of newer shows today.Speaking of gorgeous things, TBCC also brings in some of the most creative and talented cosplayers I’ve seen at a show in a while. Cosplay guest Jessica Nigri was on hand this year showing off her new Fem-Reinhardt outfit from Overwatch that had fans going crazy! With talent like this at TBCC, fans made sure to bring their A-game. Each year the cosplay has improved, and I’ve noticed that more families have been getting involved in the fun. I even saw a few pets walking around dressed up that made the dog lover in me scream for joy. 2 injured in gas cylinder explosion in Howrah

first_imgKolkata: Two youths were injured when a gas cylinder exploded at Bagnan in Howrah on Wednesday night.The injured victims were immediately rushed to RG Kar Medical College and Hospital. According to police, a gas balloon seller and a Class IX student from the locality were injured in the incident. On the occasion of Netaji’s 122nd birth anniversary, a cultural programme was going on in the area. The gas cylinder suddenly burst leaving the two seriously injured. Locals heard a loud thud and found the two youths wreathing in pain. They initially took the injured victims to Uluberia Sub-Divisional Hospital and later shifted them to RG Kar Medical College and Hospital as their condition deteriorated. The health condition of both the victims is stated to be serious. After being informed police reached the spot and cordoned off the area. They also collected samples from the place of the incident for the sake of investigation. Cops are investigating if there were faults on the part of the balloon seller.
